4. Conclusion of a contract between the Client and the Company

In order to benefit from the services provided by the Company and to make a Purchase (whether it is a Subscription or a non-subscription order), the Client must complete an online questionnaire available on the website www.hadijewelry.com. If the information disclosed by the Client is incorrect or inaccurate, the Company cannot be held responsible and does not compensate for any resulting damages.

The Customer is referred to the Privacy Charter regarding the processing of the data they provide to the Company, which they must accept when making a Purchase.

The contract concluded between the Client and the Company is valid when the payment has been made, which results in a confirmation by email.

In the absence of email confirmation, no purchase will be taken into account and the Company's liability cannot be engaged in any way.

The Company reserves the right to suspend or cancel any Purchase in the event of non-payment, payment incident, or fraud or attempted fraud. In such a case, the Customer will not be entitled to any compensation.

Subscriptions

The services provided by the Company are accessible to the Client.

In any case, the Customer can subscribe for themselves, in their own name, or gift the Subscription to a third party.

In the case of a gift given to a third party, the Customer can request (in the "Gift" section) either the sending of an email to the third party, whose details they will have provided, with an activation code.

The third party must then activate the code for the Subscription to start as soon as the code is activated.

Each subscription to a Subscription is confirmed by email to the Client. In the absence of email confirmation, no Subscription will be taken into account and the Company's liability cannot be engaged in any way.

For subscriptions, the Customer enjoys exclusive benefits, such as an exclusive 40% discount on jewelry, accumulating more loyalty points, and other offers. 

Delivery times are 2 to 4 days for standard delivery, excluding pre-order items. Shipping costs are 7 Chf for Switzerland and 4.99 € for France. Delivery is free for purchases over 60 Chf/€. Delivery is free for Hadi Prestige members.

These deadlines may vary in case of exceptional situations, such as the lockdown period related to Covid19. Please refer to our FAQ.

Monthly and annual subscription for an indefinite period

When the Client chooses to subscribe to a monthly or annual Subscription, it is without time limitation until either party decides to terminate the contract.

This is therefore a permanent contract.

The Client agrees to pay the price of their Subscription every month or year according to the chosen plan, by debit from their credit card.

The Client is charged monthly and annually for the Subscription amount. The first charge occurs on the order date. The Client receives a personal code to enter on the payment page, which allows them to take advantage of all the benefits of the Subscription.

The Client may terminate the Subscription at any time under the conditions set forth in the "unsubscription" article.

It is noted that in order to be taken into account, the unsubscription must occur before the last day of the current year.

The customer has the right of withdrawal provided for in Article 10 of these General Terms and Conditions of Sale, at the time of the initial subscription to the service: they can exercise it within 7 days for the monthly subscription and thirty days for the annual subscription following the receipt of the confirmation email of the Purchase. 

Payment is made in a single installment at the time of subscribing to the Subscription, at the rate then in effect.

5. Termination of the contract concluded between the Company and the Client

As part of the Monthly Subscription:

The Customer can terminate their Subscription at any time and without notice, respecting the stipulated deadline, which is the last day of the Subscription for the cancellation to take effect.

For example, if the Customer subscribed on January 1, 2023, and no longer wishes to be subscribed for the following month, they have until January 31, 2023, to unsubscribe.

As part of the Annual Subscription:

The Customer can terminate their Subscription at any time and without notice, respecting the stipulated deadline, which is the last day of the Subscription for the cancellation to take effect.

For example, if the Customer subscribed on February 1, 2023, and no longer wishes to be subscribed for the following year, they have until January 31, 2024, to unsubscribe.

To terminate the contract with the Company, the Client must click on the corresponding link in their personal account on the Company's website.

The cancellation will be confirmed to him by email.

6. The products

The products comply with current Swiss and French legislation. The photographs, graphics, and descriptions of the products offered for sale, both by subscription and through non-subscription items, are indicative only and do not in any way commit the Company.

The company Yerly is not the manufacturer of all the products offered. on the website www.hadijewelry.com.

7. Subscription Price and Products Sold in the Store

The selling prices of the services and products listed on the site www.hadijewelry.com are indicated in Swiss francs and euros, all taxes included, it being understood that the ordered products are billed at the prices and taxes in effect at the time of the order registration. They do not include various fees, notably shipping costs.

The price of miscellaneous fees (shipping, packaging…) is indicated at the time of Purchase.

The selling prices of services and products may be changed by the Company at any time, but this change will not affect the Subscriptions already taken out, for which the Client will continue to benefit from the rate in effect on the day of the Subscription as long as it remains in effect.

Payment is made using a credit card. The Company cannot be held responsible for any fraudulent use of a credit card.

It is the Client's responsibility to save and print their payment certificate if they wish to keep the banking details related to their transaction.

Offers are valid while stocks last.

8. Delivery Terms

Deliveries are made exclusively in Switzerland and mainland France. The delivery address is provided by the Customer at the time of Purchase. Any potential input error shall not engage the Company's liability.

Delivery times are 2 to 4 days.

For purchases outside of subscription,

Shipping costs are 7 Chf for Switzerland and 4.99 € for France. Delivery is free for purchases over 60 Chf/€. For Hadi Prestige members, delivery is free for every order.

Deliveries are made by a service provider of the Company. Delivery times are indicative. The Company cannot be held responsible for any consequences resulting from a delay in delivery.

9. Return

In addition to the withdrawal rights (see article 10), the Customer has the option to request the return of non-subscription purchases under the conditions of article 12 below.

10. Withdrawal

In accordance with the provisions of the Consumer Code, the Client who qualifies as a consumer or non-professional, or a professional not acting within the scope of their main activity, has a period of 30 calendar days from the date of receipt of their order to return their order at their own expense and to obtain a refund, without having to justify the reasons for this withdrawal. For the withdrawal of the Subscription, you have a period of 7 days for the monthly subscription and 30 days for the annual subscription. from the date of confirmation by email of their order to obtain a refund, only if the Customer has not benefited from any advantage of the Subscription. To do this, the Client must send us an email at info@hadijewelry.com or use the form on the website www.hadijewelry.com.

The Customer will be refunded the corresponding amount (excluding shipping costs paid by them during purchases outside of subscription) of the order, within 14 days from the receipt of the return, using the same payment method that the Customer used when confirming their order.

Please note that non-subscription items must be returned to us within 30 days of receiving the order. Items must be in their original packaging. This includes jewelry, pouches, and boxes. Returned products and packaging must be well protected and have a delivery tracking number. If the return conditions are not met, Yerly is entitled to refuse the refund.

 11. Deactivation of the customer account

Failure to comply with these General Terms and Conditions of Sale, any payment incident, provision of false information, or actions contrary to the interests of Hadi Jewelry will result in the temporary or permanent suspension of the customer account.

On the other hand, the rights and obligations of the Company may be assigned or transferred at any time without the prior written consent of the Client, provided that such assignment does not result in a reduction of the Client's rights.

In particular, it is specified that the Client's consent is not required in the event of the transfer of the Company's business assets to a third party.

It is specified that the transfer of the contract by means of universal transmission of assets following a restructuring operation such as a merger does not constitute a transfer.

15. Language

16. Governing law and competent jurisdiction
