Terms of Sales

PREAMBLE
Yerly operates the website www.hadijewelry.com (the "Site"), from which it offers its customers:
the purchase of high-end jewelry and accessories;
and membership in Hadi Cercle, which provides exclusive benefits reserved for its members.
1. Legal notice
The site www.hadijewelry.com is published by Yerly, whose registered office is located at: 10 rue Chantepoulet - 1201 Geneva, Switzerland.

All content on the Site (texts, visuals, logos, photographs, descriptions, etc.) is protected by intellectual property rights. Any reproduction, even partial, is strictly prohibited without the Company's prior authorization.
2. Purpose of the General Terms and Conditions of Sale
These GTC govern all sales of products and services made through the Site, whether they concern:
a one-time purchase of items, or
membership in Hadi Cercle.
Any order placed on the Site implies full and unconditional acceptance of these GTC, which the Customer acknowledges having read before making any purchase.
The Customer declares that they are of legal age and legally capable of entering into a contract.
The Company reserves the right to modify these GTC at any time. The applicable terms are those in force on the date of purchase, unless the Customer expressly accepts the new GTC.
3. Services offered
Hadi Jewelry offers on its Site:
the online sale of jewelry and accessories;
membership in Hadi Cercle, giving access to member pricing, free delivery, and benefits reserved for members.
The Site is accessible 7 days a week, 24 hours a day, except in the event of maintenance or force majeure. The Company cannot be held liable for any unavailability.
Deliveries are made in Switzerland and mainland France.
4. Account creation and conclusion of the contract
For any purchase or membership, the Customer must create a personal account by providing accurate information. Payment validation constitutes final acceptance of the contract. The Customer then receives a confirmation email.
The Company reserves the right to suspend or cancel any purchase in the event of non-payment, an incident, or suspected fraud.
5. Hadi Cercle membership
Hadi Cercle membership is entered into for a period of 12 months and renews automatically each year.
The Customer may cancel their membership until the last day of validity to avoid renewal.
Right of withdrawal: the Customer has 30 days after purchase to cancel, provided that no benefit has been used (member pricing, free delivery, extended warranty, birthday jewelry, or any other benefit). Once a benefit has been used, the membership is deemed to have been performed and the right of withdrawal no longer applies.
No right of withdrawal applies in the event of renewal or reactivation.
6. Gift cards
Hadi Jewelry also offers electronic gift cards that can be used exclusively on the site www.hadijewelry.com.
Gift cards are valid for 5 years from their date of purchase.
The recipient may use them partially or in full on one or more orders.
No refund will be issued in the event of loss or theft.
The Customer has a 30-day right of withdrawal after purchase, provided that the card has not been used.
7. Prices and payment
Prices are shown in Swiss francs (CHF) and euros (€), all taxes included. Delivery charges and additional options are specified before the order is confirmed.
Payment is made by bank card or PayPal via Shopify Payments. The Company cannot be held liable for fraudulent use of payment methods.
Offers are valid while stocks last.
8. Delivery
Deliveries are made in Switzerland and mainland France:
2 to 4 business days for standard deliveries, excluding pre-orders.
Free delivery from 100 CHF/€ purchase.
Delivery is always free for Hadi Cercle members.
Delivery times are indicative. A delivery delay cannot give rise to compensation.
9. Returns and withdrawal
a) Jewelry
The Customer has 30 days from receipt of their order to exercise their right of withdrawal and return, at their own expense, unworn items in their complete original packaging (jewelry, pouches, boxes). Products must be returned with a tracking number to the address provided by customer service.
The refund is made within 14 days from receipt of the return, using the same payment method.
b) Hadi Cercle membership
The Customer benefits from the right of withdrawal specified in article 5. No refund may be issued if a benefit has already been used.
10. Account suspension
Any payment incident, false information, or conduct contrary to the interests of Hadi Jewelry may result in the suspension or permanent deactivation of the customer account.
11. Personal data
The collected data is processed in accordance with the Privacy Policy available on the Site: https://hadijewelry.com
12. Assignment of contract
The Customer may not assign the contract concluded with the Company without its prior consent. The Company may transfer all or part of its rights and obligations to a third party, without reducing the Customer's rights.
13. Governing law and jurisdiction
These GTC are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Geneva.
14. Language
In the event of a translation, only the French version shall prevail in the event of any difference in interpretation.
