PREAMBLE

The company Yerly operates the website www.hadijewelry.com (the "Site"), from which it offers its customers:

  • the purchase of high-end jewelry and accessories;

  • and the subscription to a Hadi Prestige Membership, offering exclusive benefits reserved for its members.

1. Legal Notice

The website www.hadijewelry.com is published by the company Yerly, whose registered office is located at:
10 rue Chantepoulet – 1201 Geneva, Switzerland.

All content on the Site (texts, visuals, logos, photographs, descriptions, etc.) is protected under intellectual property law.
Any reproduction, even partial, is strictly prohibited without prior authorization from the Company.

2. Purpose of the General Terms and Conditions of Sale

These GTC govern all sales of products and services made via the Site, whether it is:

  • a one-time purchase of items, or

  • a subscription to a Hadi Prestige Membership (monthly or annual).

Any order placed on the Site implies full and unconditional acceptance of these GTC, which the Customer acknowledges having read before any purchase.

The Customer declares to be of legal age and legally capable of entering into a contract.

The Company reserves the right to modify these GTC at any time. The applicable conditions are those in force on the date of purchase, unless the Customer expressly accepts the new GTC.

3. Services Offered

Hadi Jewelry offers on its Site:

  • the online sale of jewelry and accessories;

  • the subscription to the Hadi Prestige Membership, giving access to exclusive discounts, free shipping, and privileged offers.

The Site is accessible 24/7, except for maintenance or force majeure.
The Company cannot be held responsible for any unavailability.

Deliveries are made in Switzerland and mainland France.

4. Account Creation and Conclusion of Contract

For any purchase or subscription, the Customer must create a personal account by providing accurate information.
Validation of payment constitutes final acceptance of the contract.
The Customer then receives a confirmation email.

The Company reserves the right to suspend or cancel any purchase in case of non-payment, incident, or suspected fraud.

5. Hadi Prestige Memberships

a) Monthly Membership – no commitment

  • The monthly Membership is automatically renewed each month until canceled by the Customer.

  • The Customer may end their membership at any time, from their customer account, before the next due date.

  • Right of withdrawal: the Customer has 7 days after purchase to cancel, provided no benefit has been used.

  • No right of withdrawal applies in case of renewal or reactivation.

b) Annual Membership – 1-year commitment

  • The annual Membership is entered into for a period of 12 months and is automatically renewed each year.

  • The Customer may cancel their membership up to the last day of validity to avoid renewal.

  • Right of withdrawal: the Customer has 30 days after purchase to cancel, provided no benefit has been used.

  • No right of withdrawal applies in case of renewal or reactivation.

6. Gift Cards

Hadi Jewelry also offers electronic gift cards usable exclusively on the website www.hadijewelry.com.

  • Gift cards are valid for 5 years from their date of purchase.

  • The recipient may use them partially or fully on one or more orders.

  • No refund will be made in case of loss or theft.

  • The Customer has a 30-day right of withdrawal after purchase, provided the card has not been used.

7. Price and Payment

Prices are indicated in Swiss francs (CHF) and in euros (€), all taxes included.
Shipping fees and additional options are specified before order confirmation.

Payment is made by credit card or PayPal via Shopify Payments.
The Company cannot be held responsible for fraudulent use of payment methods.

Offers are valid while stocks last.

8. Delivery

Deliveries are made in Switzerland and in mainland France:

  • 2 to 4 business days for standard deliveries, excluding pre-orders.

  • Free delivery from 60 CHF/€ of purchase.

  • Always free delivery for Hadi Prestige members.

Delivery times are indicative. A delivery delay cannot give rise to compensation.

9. Returns and Withdrawal

a) Products outside of membership

The Customer has 30 days from receipt of their order to exercise their right of withdrawal and return, at their own expense, unworn items in their complete original packaging (jewelry, pouches, boxes).
Products must be returned with a tracking number to the address provided by customer service.

Refunds are made within a 14-day period from receipt of the return, via the same payment method.

b) Memberships

The Customer benefits from the right of withdrawal specified in Article 5 according to the chosen plan.
No refund can be made if a benefit has already been used.

10. Account Suspension

Any payment incident, false information, or behavior contrary to the interests of Hadi Jewelry may result in the suspension or permanent deactivation of the customer account.

11. Personal Data

Data collected is processed in accordance with the Privacy Policy available on the Site: https://hadijewelry.com

12. Assignment of Contract

The Customer may not assign the contract entered into with the Company without its prior consent.
The Company may transfer all or part of its rights and obligations to a third party, without reducing the Customer's rights.

13. Applicable Law and Jurisdiction

These GTC are governed by Swiss law.
Any dispute will be subject to the exclusive jurisdiction of the courts of Geneva.

14. Language

In case of translation, only the French version shall prevail in case of any discrepancy in interpretation.
